Reproductions

The reproduction of materials belonging to the Library’s collections is regulated on the basis of Articles 108 c. 3 and 3bis of Legislative Decree 42/2004, as amended, and the guidelines set forth in the Decree of the Minister of Culture, 11 April 2023, rep. 161, as amended by Ministerial Decree 21 March 2024, rep. 108.

La fotoriproduzione con mezzi propri è libera se “attuata nel rispetto delle disposizioni che tutelano il diritto di autore e con modalità che non comportino alcun contatto fisico con il bene, né l’esposizione dello stesso a sorgenti luminose né, all’interno degli istituti della cultura, né l’uso di stativi o treppiedi”.
La Biblioteca non dispone di macchine fotocopiatrici.

DIGITAL REPRODUCTION REQUESTS

Requests for digital reproductions may only be submitted to the Library at b-stmo.fotoriproduzioni@cultura.gov.it and are reimbursed according to the following schedule:

Once confirmation of the possibility of supply and the cost estimate has been received from the Office, payment must be made by one of the following methods:

Due to the severe shortage of staff at the Institute, the Library reserves the right to refuse requests for the reproduction of entire volumes or large requests for numerous documents.

No reimbursement of costs is due for reproductions already available online, which remain freely downloadable from the Library’s digital repository.

REQUEST FOR USE OF IMAGES IN PUBLICATIONS OR OTHER INITIATIVES

If you use the images in a publication, you are required to

IMPORTANT: Reproduction fees and charges in favour of the Library do not include any rights due to third parties on works protected by copyright law. Those who use reproductions of the aforementioned materials undertake to independently identify the rights holders and settle the rights due.

  1. USES EXEMPT FROM FEE

As per Ministerial Decree 21 March 2024, rep. 108, they are free of charge:

  1. reproductions of cultural goods and their reuse for volumes recognised by the granting body as scientific (contributions in volumes, proceedings of national and international conferences) and academic;
  2. reproductions of cultural goods and their re-use for volumes and journals whose popular and educational content is recognised by the granting body;
  3. reproductions of cultural goods and their reuse for art, exhibition and cultural event catalogues with a print run of up to 4,000 copies;
  4. reproductions of cultural goods and their reuse for scientific and Class A journals on the lists of the National Agency for the Evaluation of the University System and Research (ANVUR);
  5. reproductions of cultural goods and their re-use for publications in newspapers and periodicals in the exercise of the right to report;
  6. reproductions of cultural goods and their re-use for publications freely accessible by anyone without payment of a price (so-called open access);
  7. reproductions of cultural goods made independently by anyone (e.g. students, scholars, researchers, academics) for non-profit purposes and not intended for sale;
  8. reproductions of cultural goods and their re-use for the creation of exhibition, scientific, didactic and popular material for exhibitions and cultural events organised by a body of the Ministry or by public and private entities for the purpose of enhancing the cultural heritage, implemented on a non-profit basis. In the case of requests for a large number of images, free admission can only be granted within the framework of institutional collaboration agreements. It should be noted that the admission fee is not sufficient in itself to characterise a valorisation initiative as profit-making, but the totality of the circumstances in which the initiative is implemented must be assessed.

Applicants are obliged to reimburse any costs incurred by the Administration to carry out reproductions. Reimbursement only concerns the costs incurred in connection with the request for reproduction, i.e. the costs incurred for reproductions ex novo and for supply. No reimbursement of expenses is due for reproductions already available online that remain freely downloadable and for reproductions made directly by private individuals provided that they are made in compliance with the provisions of Section 108(3-bis)(1) of the Code.

The amount of reimbursement is determined on the basis of a Unit Fee, calculated on the basis of Table 1.

2. USES SUBJECT TO PAYMENT OF A FEE Where reproductions of cultural goods and/or the re-use of copies or images thereof are made outside the cases set out in the preceding paragraph, the applicant shall pay a fee, which is determined by multiplying:

  • the Unit Fee in Table 1 (Reimbursement for Reproductions)
  • a coefficient differentiated according to the use/destination of the reproductions, as set out in Table 2 (Use/destination of reproductions), except for the case of no. 8, the value of which must instead be added; for a coefficient relating to the quantity of reproductions to be made (minimum and maximum number of reproductions on different size classes) or relating to the print run (minimum and maximum number of copies of the publications for which the reproductions are to be used), according to Table 3 (Quantity/Third run of reproductions – Online publishing products – Audiovisual screenings and/or immersive exhibitions). The quantity and circulation coefficients are applied alternately according to the type of reproduction of the good (e.g. circulation for publications, quantity for derivative products or d. gadgets).

In the event that the reproductions are already in the possession of the person requesting only their re-use, the basic unit fee to be used for the calculation of the remuneration shall be set at a flat rate of 5.00 euros, unless a lower reimbursement is provided for in Table 1.

The determination of the fee is the responsibility of the Library Management, which must assess, on a case-by-case basis, the intended use of the request, and the possible reduction of the fee in special cases:

  1. a) Application coming from another administration or public body or Third Sector body
    In the event of a request coming from another administration or public body on the list drawn up annually by ISTAT (Article 1, paragraph 2, of Law No. 196 of 31 December 2009) or from a Third Sector body or, in any case, for initiatives with a meritorious social content, the authority that is in charge of the property may consider a reduction or cancellation of the fee.
  2. b) Selective contributions and ‘difficult works

The amount of the fee may be reduced for the cases of granting selective contributions referred to in Article 26, of Law No. 220 of 14 November 2016, and in the cases of difficult works referred to in Article 4, paragraph 3, of the Ministerial Decree of 4 February 2021, on ‘Implementing provisions on tax credit for film and audiovisual production companies referred to in Article 15 of Law No. 220 of 14 November 2016’, in consideration of the prevalence of the cultural purposes of the film and audiovisual work.

  1. c) Publishing products

In the case of publishing products with a large number of images, the delivering authority may assess a reduction in the amount of the fee in the case of an excessive percentage of the cover price.
